Our Website are offered and available to users who are 17 years of age or older. Terms of Sale
Subscription Plans
BioNeex offers a range of subscription plans to our online platform (the “Platform”). To view the specific details of your plan, including pricing and start date of your next automatic renewal period, go to the billing page of your account. Any amendment to fees or discounts published on the Website shall have no retroactive effect, and any discounts applied to a previous subscription may not apply to renewed subscriptions, including automatic renewals.
Fees
As an express condition of your use of and access to the Platform, you agree to pay an annual, non-refundable (unless refund is required by applicable law) registration fee (the “Registration Fee”). Your registration will not be complete and you will not be able to access the Platform until full prepayment of the Registration Fee has been made. We have the right to suspend or block your account at any time if you have not paid the Registration Fee in full. We will not exercise such right if you are disputing the applicable charges reasonably and in good faith and are cooperating diligently to resolve the dispute.
The Registration Fee includes all applicable taxes.
The Registration Fee shall be transferred via wire transfer to BioNeex’s bank account referenced on the Website or credit card payment. Except as otherwise specified herein, the Registration Fee is based on subscription purchases and not actual usage. Annual subscription access period shall start on the day upon which we receive your Registration Fee and ends on the one-year anniversary thereof.
Unless otherwise stated, all fees are stated in U.S. Dollars.
Credit Card Payments
In the event you opt for credit card payment, we will bill Registration Fees in advance of each billing cycle to the credit card you provide upon registration (or different credit card if you update your payment information). You authorize your credit card issuer to pay any and all applicable fees for your subscription and authorize us or billing agent acting on our behalf to continue charging all such amounts to your credit card account until you or we cancel or terminate your subscription as provided herein or these amounts are paid in full, whichever is later.
You must provide current, complete and accurate billing and credit card information. You must promptly update all billing information (such as billing address, card number and expiration date) to keep your account current, complete and accurate, and you must promptly update your payment information if your credit card is lost, stolen, expired, or otherwise cannot be charged sufficiently to cover Registration Fees.
You authorize us to obtain or determine updated or replacement expiration dates for your credit card in the event that the credit card you provided us expires and you have not updated your billing information. We reserve the right, and you authorize us, to charge any renewal card issued to you to the same extent as the expired card.
If we do not receive payment from your credit card issuer, you agree to pay all amounts due upon demand. You further agree to pay all costs of collection, including attorney’s fees and costs, on any outstanding balance.
In certain instances, your credit card issuer may charge you a foreign transaction fee or other charges, which you will be responsible to pay. Please check with your bank and/or credit card issuer for details.
Renewal
At the end of your current subscription period, your subscription will automatically renew for a subscription period equal to your prior subscription period unless you cancel as set forth below.
Cancellation/Termination
If you wish to cancel, you must do so before your subscription renews in order to avoid fees due under the next billing cycle. No refunds or credits will be provided for partial or unused months.
The only valid method for cancelling your subscription is via the billing page of your account. Requests to cancel by e-mail, phone, or any other alternative methods are not considered, and do not accomplish, cancellation.
If you cancel your subscription, you will lose all access, upon the expiration of your current pre-paid period, to the Platform and any data and/or information stored in your account. If we terminate your subscription in accordance with these Terms of Use, effective upon such termination/cancellation, you will immediately lose all access to the Platform and any data and/or information stored in your account.
Intellectual Property Rights
The Website and their entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
Terms of Use permit you to use the Website for your personal, non-commercial use as well as legitimate business purposes relating to your role as a potential or current user/customer of Company. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Website, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials. We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law.
